  1. General information

1.1 Below, we provide information about how we process your personal data for the purposes of contacting you, as well as for applications and selection for our anniversary campaign and its implementation and marketing.

You can apply to be part of our FALKE anniversary campaign by sending an email to Ms. Alina Wahle-Kube ([email protected]).

1.3 The personal data processed as part of the application process includes data from audio and photo recordings, metadata, and other data that you provide to us during the application process. As part of your participation in the FALKE anniversary campaign, data from audio, photo, and video recordings, metadata, and the data and contact details specified in the model release agreement (e.g. name, date of birth, address, telephone number, email address), including data on height, clothing size, and shoe size, will be processed. In addition, we process data that you provide to us in interviews conducted as part of the anniversary campaign.

1.4 You have the following rights with regard to the personal data concerning you, which you can assert by notifying us at the contact details provided:

Right to information (Art. 15 GDPR),

Right to rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR),

Right to restriction of processing (Art. 18 GDPR),

Right to object to processing (Art. 21 GDPR) and

Right to receive the data in a structured, commonly used, machine-readable format (“data portability”) and right to transfer the data to another controller if the conditions of Art. 20 (1) lit. a, b GDPR are met (Art. 20 GDPR).

1.5 You also have the right to lodge a complaint with a data protection supervisory authority about our processing of your personal data (Art. 77 GDPR).

  1. Contact

If you contact us as part of the anniversary campaign, e.g. by email, the personal data you provide will be processed by us for the purpose of responding to your enquiry. The legal basis for the processing is Art. 6 (1) (f) GDPR. Our legitimate interest in processing your data also lies in responding to your inquiry. In this context, your data will not be passed on to third parties. We will delete the data collected in this context once it is no longer required for processing or restrict processing to comply with existing mandatory legal storage obligations.

You can object to the processing of your contact requests. Your right to object exists for reasons arising from your particular situation. You can send us your objection using the contact details provided.

  1. Application process

We process the contact details you provide, as well as any photos and stories you submit, for the purpose of selecting your application for participation in the anniversary campaign. The legal basis for processing is Section 26 (1) BDSG in conjunction with Art. 6 (1) (b) GDPR. The provision of your data is necessary for the review and selection of your application. Without this data, participation in the application process is not possible. We process your data until it is no longer necessary for the selection process for the FALKE anniversary campaign or restrict processing to compliance with existing statutory retention obligations.

  1. Participation in the FALKE anniversary campaign

4.1 When producing and publishing audio, photo, and video recordings as part of the FALKE anniversary campaign, our cameras also process metadata such as the time, location, and date of the recording for technical reasons. The purposes of processing are the production, documentation, public relations, and marketing of recordings from the shoot. In addition, we process data on your height, clothing size, and shoe size in order to provide you with the products for the campaign shoot.

We also conduct interviews with you about the stories you shared during the application process and publish these interviews on the company's internal intranet and on LinkedIn.

4.2 The legal basis for the processing of your data is Section 26 (1) BDSG in conjunction with Art. 6 (1) (b) GDPR. The processing of your data is necessary for the fulfillment of the model release agreement concluded with you. The model release agreement cannot be fulfilled without this data.

4.3 We only process your data for as long as it is necessary to fulfill the model release agreement concluded with you. In addition, we store your personal data until the statute of limitations expires for any legal claims arising from the contractual relationship. The limitation period is usually between 12 and 36 months, but can also be up to 30 years.

  1. Categories of recipients

5.1 Within our company, those departments that need your data to fulfill our contractual and legal obligations will have access to it. Service providers and vicarious agents employed by us (e.g., technical service providers, photographers, stylists) may also receive data for these purposes. We limit the disclosure of your personal data to what is necessary, taking into account data protection regulations. In some cases, the recipients receive your personal data as processors and are then strictly bound by our instructions when handling your personal data. In some cases, the recipients act independently under their own data protection responsibility and are also obliged to comply with the requirements of the GDPR and other data protection regulations.

5.2 Your personal data will only be processed in a so-called third country if there is an adequacy decision by the European Commission or if another justification or exception applies to the transfer to the third country in accordance with Art. 46 ff. GDPR. In the case of processing within the European Union, it cannot be ruled out that the websites concerned may also be accessed from countries that do not have an adequate level of data protection.
